1. About Sonaya

Sonaya is operated by Dinkel AI & Media Tech GmbH, Simmeringer Hauptstraße 24/220, 1110 Vienna, Austria. Commercial register number: FN 659333 h, Commercial Court of Vienna (Handelsgericht Wien). Contact: support@sonaya.ai.

Sonaya creates personalized guided meditations spoken in a synthetic copy of your own voice: you describe what is on your mind, record a short voice sample, and the app generates a meditation for you. Meditations are generated by artificial intelligence and are marked as such in the app.

2. Acceptance

By creating an account or using Sonaya you accept these Terms. If you do not agree, do not use the service. The licence to the app itself is granted under your app store's standard licence terms; these Terms govern the Sonaya service. Consent to voice and text processing is separate from these Terms and is collected in the app (section 3).

3. Your voice and what you write

Separate consent. Before you record your voice or write anything, the app asks for your explicit, separate consent to processing your voice as biometric data and your text, which may reveal information about your health. This consent is independent of these Terms and can be withdrawn at any time in the app without losing your account.

You own your voice. You keep all rights to your voice recordings. We receive a limited, non-exclusive right to process them solely to provide the service. We do not claim ownership of your voice. Your voice clone is for your personal use only: you may not sell, transfer or commercially exploit it.

Your declarations. You confirm that the voice you record is your own and that you are not impersonating anyone. You must not: record another person; use voice technology to impersonate, deceive, harass or abuse anyone; or generate content that violates the law. Violation may lead to immediate termination of your account.

4. Subscription, prices and billing

One plan. Sonaya has a single subscription:

A subscription includes 10 meditations per subscription month — the month runs from your billing date, not the calendar. Above that, you can buy additional meditations at €1 each, up to 5 per subscription month; they apply to the current month. During the free trial, creation is not capped. Without a subscription you can create one free meditation when you first try Sonaya; one per person and device.

Prices are shown in the app before you pay and include VAT where applicable.

Billing runs through Apple and Google. You buy the subscription inside the app through the Apple App Store or Google Play; they process the payment under their own terms. We never see or store your payment card details.

Automatic renewal. Your subscription renews automatically for the same period (one month or one year) at the price shown when you subscribed, unless you cancel at least 24 hours before the current period ends. You cancel in your Apple or Google subscription settings, at any time, without any fee; you keep access until the end of the paid period. The store may also remind you before a renewal — but do not rely on a reminder.

Trial. New subscriptions start with a 7-day free trial. If you do not cancel before the trial ends, the paid subscription starts automatically. The store shows you the trial terms before you confirm.

When your subscription ends. The meditations in your library stay there and remain playable in the app, free of charge — for as long as your account exists, your voice-and-text consent stands and Sonaya operates. A subscription or remaining allowance is needed only to create new ones. If you withdraw consent or delete your account, the library is deleted (see the Privacy Policy). If we ever close Sonaya, section 9 applies.

What you need. Sonaya runs on iOS 15.1 or later and Android 7.0 or later, needs an internet connection to create meditations, and a microphone for the voice recording. We provide the updates needed to keep the app working for as long as you have a subscription.

Right of withdrawal and refunds. Your subscription is sold to you by Apple or Google, and your statutory 14-day right of withdrawal for that purchase is exercised through their refund process — both provide one for EU purchases; if you have trouble with it, write to support@sonaya.ai and we will help. Your contract with us for using the app — including the free meditation — is also a distance contract: you may withdraw from it within 14 days of creating your account, without giving reasons, by writing to support@sonaya.ai (you may use the model form at the end of these Terms). Because you ask us to start the service immediately, you acknowledge that once a meditation has been created for you, the right of withdrawal no longer covers that meditation.

Price changes. If we raise the price, the store will ask you to agree to the new price before it applies. If you do not agree, your subscription ends at the close of the period you have already paid for. A new price never applies to a period you have already paid.

5. Your account

You need an account to save meditations; you can start anonymously and add an email later. Keep your sign-in data confidential. You are responsible for activity under your account unless you are not at fault for it — for example if someone gained access despite your reasonable care. You must be 18 or older to use Sonaya (section 13).

Acceptable use. Use Sonaya only for its purpose — your own meditation practice. Do not attempt to break, overload or misuse the service, reverse-engineer it except where the law expressly permits, resell access, or use it to build a competing product.

6. Intellectual property

Ours. The Sonaya platform — software, design, brand, trademarks — belongs to Dinkel AI & Media Tech GmbH and is protected by law.

Yours. You keep full ownership of your voice recordings and the texts you write. Meditations generated for you are yours to access and use for personal, non-commercial purposes — during and after your subscription (section 4), unless you withdraw your consent or delete your account.

AI-generated content. The copyright status of AI-generated works is still evolving in law. Regardless of that: you may not sell or commercially distribute generated meditations, claim exclusive copyright in them, or use them to train competing AI systems.

Feedback. If you send us ideas or suggestions, you allow us to use them to improve Sonaya, without payment, on a non-exclusive basis. This covers the idea — not your personal data or the wording of your message, which we handle under the Privacy Policy.

7. Service availability and changes

Meditations are generated by AI on third-party systems — that is the nature of the product: generation can take time, be temporarily unavailable, and the result is not identical every time. We keep the service available and fix defects as the law on digital services requires, and we may improve or change features over time. If a change reduces what you pay for in a way that is more than minor, we will tell you at least 30 days in advance; you may then end your subscription free of charge within 30 days, and we will refund the unused part of the period you paid for.

8. Medical disclaimer and liability

Sonaya is NOT a medical device or therapy service. It does not diagnose, treat, cure or prevent any medical or mental-health condition and is not a substitute for professional care. If you are in crisis or concerned about your health, contact a healthcare professional or local emergency services.

Statutory warranty. As a consumer you have the statutory warranty rights for digital services under Austrian law — for the whole time you have a subscription, and at least two years for anything supplied once. Nothing in these Terms reduces them.

Liability. We are liable without limitation for damage we cause intentionally or by gross negligence, and for personal injury in every case. For damage caused by slight negligence we are liable only where mandatory consumer law says so. We are not liable for a meditation being unsuitable for you — see the medical notice above.

9. Termination

By you. Delete your account in the app at any time — the deletion itself is immediate (see the Privacy Policy for what happens to your data). Deleting the account does not cancel a store subscription: cancel it in your Apple or Google settings, otherwise the store keeps billing you.

By us. If you break these Terms, we will normally warn you and give you a chance to fix it. In serious cases — recording someone else's voice, impersonation, harassment, illegal content, fraud — we may end your account immediately. We will tell you the reason unless the law prevents it. Any subscription you bought continues to be governed by your store's terms.

If we close Sonaya. We may stop offering the service, with at least three months' notice in the app and by email where we hold it. Before the closing date you will be able to download your meditations, and we will refund the unused part of any subscription period you paid for.

10. Third-party services

Voice synthesis and script generation run on third-party AI providers; sign-in and payments run on Apple and Google. Who receives what data is described in our Privacy Policy — including the fact that our AI providers never receive your identity.

11. Governing law and disputes

These Terms are governed by Austrian law. For consumers, the mandatory consumer-protection rules of your country of residence remain applicable. Place of jurisdiction for entrepreneurs is Vienna; for consumers, statutory jurisdiction rules apply. We are not obliged to take part in dispute-resolution proceedings before a consumer arbitration board and do not participate voluntarily.

12. Privacy

How we handle your data is described in our Privacy Policy at sonaya.ai/privacy-policy.html — including what we collect, who receives it, how long we keep it and your rights.

13. Age

Sonaya is for adults: you must be 18 or older. You confirm this in the app before recording or writing anything. If we learn that a minor has used the service, we delete the account and its data; parents and guardians can contact support@sonaya.ai (see the Privacy Policy for the procedure).

14. Changes to these Terms

We may change these Terms for a good reason — a change in the law, in the app stores' requirements, in our providers, or in the service's features — and only to the extent that reason requires; we will never use a change to alter prices, your existing library or your consent. We will show the new version in the app and, where we hold your email address, send it by email, at least 30 days before it takes effect, and tell you in that notice that the change will apply if you do not object. If you object before that date, the old Terms continue to apply to you, and either of us may end the contract at the end of the current subscription period. Purely editorial changes take effect on publication.

15. Final provisions

If a provision is invalid, the rest remains in force. Our not enforcing a right is not a waiver. If Dinkel AI & Media Tech GmbH is merged into or taken over by another company, the contract passes to that company by operation of law; in any other case we would transfer your contract only with your agreement. These Terms are published in English and German; if the versions differ, the English version prevails. Legal notices: support@sonaya.ai.
